Apple drohen Steuernachzahlung von bis zu 13 Milliarden Euro in Irland

Was in der Bundesliga das legendäre Festgeld-Konto der Bayern ist, ist in der Technologiebranche der Liquiditäts-Speicher von Apple. Um die 220 Milliarden US-Dollar soll man dort bereits an Barreserven angehäuft haben. Diese Summe dürfte sich nun allerdings um ein gutes Stück reduzieren. Heute hat nämlich die EU-Kommission entschieden, dass Apple in den Jahren 2003 bis 2014 unerlaubte Steuervergünstigungen in Höhe von bis zu 13 Milliarden Euro in Irland erhalten habe, die Irland nun samt Zinsen zurückfordern muss. EU-Wettbewerbskommissarin Margrethe Vestage sagte zu dem Vorgang: "Die Kommission gelangte bei ihrer Prüfung zu dem Schluss, dass Irland Apple unzulässige Steuervergünstigungen gewährt hat, aufgrund derer Apple über viele Jahre erheblich weniger Steuern zahlen musste als andere Unternehmen."

Da laut den EU-Beihilfevorschriften gezielte Steuervorteile für einzelne Unternehmen unzulässig sind, hatte die EU-Kommission bereits im Jahr 2014 eine Überprüfung der Steuervereinbarungen zwischen Irland und Apple untrersucht. Nun ist man offenbar zu dem Ergebnis gekommen, dass diese unzulässig sind und Apple sämtliche Vergünstigungen nachträglich begleichen muss. Irland wird bereits seit einiger Zeit vorgworfen, internationale Steuerregeln zu umgehen, um auf diese Weise Arbeitsplätze ins Land zu holen.

Apple CEO Tim Cook hat inzwischen in einem offenen Brief auf das Urteil reagiert und darin angekündigt, dass Apple in Berufung gehen wird. Cook geht dabei auch vor allem auf die Auswirkungen des Urteils für durch amerikanische Unternehmen in der EU geschaffene Arbeitsplätze ein: "Beyond the obvious targeting of Apple, the most profound and harmful effect of this ruling will be on investment and job creation in Europe. Using the Commission’s theory, every company in Ireland and across Europe is suddenly at risk of being subjected to taxes under laws that never existed." Eine kurzfristige Einigung erwartet man in Cupertino nicht. Stattdessen geht man davon aus, dass sich der Rechtsstreit über Jahre hinziehen wird, weswegen wohl keine kurzfristigen Auswirkungen auf die Zahlen in der näheren Zukunft zu erwarten sind: "How does this decision impact Apple’s near-term financial results? Will you take a tax charge? Does this alter your previous guidance? We do not expect any near-term impact on our financial results nor a restatement of previous results from this decision. We have previously accrued U.S. taxes related to the income in question. The tax rate guidance for Apple’s fourth fiscal quarter that we provided on July 26, 2016 does not change as a result of this decision."
