Apple dementiert Zugriff für US-Behörden auf seine Server

Aktuell macht ein Bericht der Washington Post von sich Reden, in dem es um ein geheimes US-Regierungsprojekt namens PRISM geht. Im Rahmen dieses Projekts soll der US-Militärnachrichtendienst NSA (National Security Agency) angeblich autorisierten Zugriff auf zentrale Server mehrerer führender Internet-Unternehmen haben, zu denen neben Facebook, Google, Microsoft, Yahoo und AOL auch Apple gehört. PRISM soll der Washington Post zufolge im Jahr 2007 ins Leben gerufen worden sein, um Kommunikationsdaten im Internet zu sammeln. Hierunter fallen neben E-Mails auch Sprach- und Videochats, sowie Fotos und sonstige übertragene Dateien. 2008 wurde die Teilnahme an dem Projekt dann per Gesetz auch für Unternehmen legalisiert. Eines der ersten Unternehmen, das sich an PRISM beteiligt haben soll war seinerzeit Microsoft. Google und Yahoo sollen dem Beispiel recht bald gefolgt sein, so dass diese drei Unternehmen aktuell 98% der Daten liefern sollen. Apple sei im Oktober 2012 in das Programm aufgenommen worden. Mittlerweile haben sich unter anderem Apple, Facebook, Google und Yahoo zu dem Bericht geäußert und eine Beteiligung an PRISM abgestritten. Apple äußerte sich gegenüber AllThingsD mit den Worten: "We have never heard of PRISM. We do not provide any government agency with direct access to our servers, and any government agency requesting customer data must get a court order." Letzteres kommuniziert Apple übrigens auch bereits seit geraumer Zeit öffentlich in seiner Datenschutzrichtlinie (Abschnitt "Weitergabe an Dritte - Andere Dritte"): "Mitunter kann es für Apple notwendig sein – aufgrund von gesetzlichen Bestimmungen, rechtlichen Verfahren, Rechtsstreitigkeiten und/oder Aufforderungen von öffentlichen und Regierungsbehörden innerhalb oder außerhalb deines Wohnsitzlandes – personenbezogene Daten offenzulegen. Außerdem können wir Daten über dich offenlegen, wenn wir der Überzeugung sind, dass dies für die nationale Sicherheit, den Gesetzesvollzug oder andere öffentliche Interessen notwendig oder angemessen ist."

Auch die US-Behörden haben inzwischen reagiert. In einer Stellungnahme erklärte der Leiter der nationalen Nachrichtendienste, James Clapper, dass der Zeitungsbericht in weiten Teilen ungenau ist und die Herausgabe von Daten nur auf Beschluss eines Sondergerichts hin erfolgen könne. Allerdings besitzt dieses Gericht schon beinahe Immunität, fasst seine Beschlüsse in der Regel geheim und beteiligt auch die Zivilbevölkerung nicht. Clepper betonte, dass alle Vorgänge lediglich zum Schutz der US-Bevölkerung dienen. Durch spezielle Vorkehrungen seien von PRISM zudem nur wenige US-Bürger betroffen, da die NSA als Auslandsgeheimdienst fungiert. Daten von Nutzern aus anderen Ländern werden jedoch offenbar analysiert und ausgewertet. Zumindest wenn der Bericht stimmen sollte, würde dies unter anderem auch Deutschland in den Fokus von PRISM rücken. Allerdings scheinen auch US-Bürger für die NSA interessant zu sein. So wurde gestern erst bekannt, dass die Behörde Gespräche, die über den amerikanischen Mobilfunkanbieter abgewickelt werden, sammelt und bei Bedarf auswertet. Wie weit die Daten-Zugriffe reichen, wird in beiden Fällen allerdings vermutlich niemals öffentlich werden.

Öffentliche Interessen umfassen quasi alles, um das sich der Staat kümmert. Das bedeutet nichts anderes, als dass sich Apple das Recht vorbehält, auf staatlichen Wunsch - ohne gesetzliche Verpflichtung - alle Daten offen zu legen. Das steht im Widerspruch zu dem öffentlichen Dementi.
