Apple stark betroffen: Die EU treibt die Arbeit am Digital Markets Act weiter voran

Der Digital Markets Act (DMA) der EU wirbelt aktuell ähnlich viel Staub auf wie einst die DSGVO und könnte große Auswirkungen, vor allem auch auf Apple haben. Den Kollegen von MacRumors liegt eine aktuelle Fassung des Dokuments vor, in dem die neuen Richtlinien für Betreiber von digitalen Diensten dargelegt werden. Unter anderem soll der DMA dafür sorgen, dass Anbieter wie Apple und Google ihre eigenen Dienste nicht gegenüber Konkurrenzangeboten von Drittanbietern bevorzugen oder auch dass sämtliche Apps deinstallierbar sein müssen. Leistet man dem nicht folge, drohen hohe Strafen, bis hin zu 10% des jährlichen Umsatzes.

Auf Seiten Apples dürfte vor allem der iOS AppStore betroffen sein. Einer aktuellen Fassung des DMA zufolge dürfte Apple nämlich dazu gezwungen werden, diesen dahingehend zu öffnen, dass die Nutzer auch Apps direkt aus dem Internet oder aus AppStores von Drittanbietern installieren können dürfen. Mit anderen Worten, würde dies das "Sideloading" von Apps möglich machen. Auch sollen Entwickler kümftig Alternativen zu Apples In-App Bezahlsystem nutzen dürfen. Ebenfalls Apple betreffend ist eine Passage, die eine freie Wahl bei der Browser-Engine ermöglichen soll. Aktuell unterstützt Apple unter iOS und iPadOS ausschließlich die Verwendung von WebKit als Engine.

Auch die bereits vor einigen Wochen thematisierte Interoperabilität zwischen den verschiedenen Messengerdiensten soll durch den DMA kommen. Somit sollen die Nutzer nicht gezwungen werden, nur weil ein Großteil ihrer Kontakte bei WhatsApp ist, ebenfalls WhatsApp zu nutzen. Stattdessen sollen die per WhatsApp verschickten Nachrichten dann auch beispielsweise per Signal oder iMessage empfangen werden können. Wie genau man dies aber mit Blick auf die Ende-zu-Ende Verschlüsselung und damit auch unter Berücksichtigung des von Apple immer wieder propagierten Datenschutzes der Nutzer technisch bewerkstelligen möchte, steht noch in den Sternen.

Es ist wie mit jeder anderen Regelung. Sie entstehen, weil eine Partei einen "gesellschaftlich nicht akzeptierten" Vorteil verschafft und es zu einem erheblichen Missverhältnis kommt.

Vor 20 Jahren wurde §434 BGB eingeführt. Fehlerhafte oder unvollständige Anleitungen von Möbeln stellten nach zweihundert Jahren plötzlich einen Mangel da.
Warum diese Regelung eingeführt wurde? Der Name IKEA-Klausel gibt euch einen Tipp. ;-)

Bei Apple nichts anderes.

Der Begriff "Sideloading" war vor iOS völlig unbekannt. Es war Grundlage des Computers, dass man ihn nutzen konnte, wie man wollte. Nur für iOS wurde ein Begriff erfunden, der auch noch ausdrückt, dass es etwas Unnormales (neben der Spur) wäre.

Browserengine... wir brauchen nicht drüber reden. Safari ist verbuggt und im unteren Drittel der HTML5-Kompatibilität. 2009 jammerte MacTV, dass alle Entwickler Mehrarbeit durch den IE leisten müssen. Heute hat diese Position der Safari eingenommen.

Konkurrenz belebt das Geschäft. Und wenn eine Partei sich diese Mühe nicht machen will, muss der Staat eben nachhelfen.

An der Stelle noch mal:
Würde Apple sich Mühe geben, Safari top of the edge halten, Geld in die Verwaltung des AppStore investieren, so dass Klagen non Entwicklern gar nicht aufgetreten wären, dann hätte der Gesetzgeber niemals Notwendigkeit gesehen.
Der Konzern ist selber schuld.

Messenger... müsste man sich im Detail anschauen. Ich glaube nicht, dass es auch verschlüsselte Verbindungen betrifft. Bin aber nicht sicher.

Gut, die kontrollierten Tankstellen verhindern nicht, dass du dort zwischendurch ausgeraubt wirst. Die Tankstellenbetreiber beschweren sich, dass VW seine eigenen Tankstellen bevorzugt und VW akzeptiert sogar Betrüger, die dir nur Wasser verkaufen.
Aber hey, dass VW an den Gebühren verdient und diese Betrüger in den Top10 landen, ist sicher nur Zufall.

Das eigenständige Betanken, ohne dass VW eine Gebühr erhebt, ist eine absolute Gefahr für jeden Autofahrer. Wir wissen doch alle, dass außer den VW Polos die VW Passats und natürlich auch alle Toyotas wenigstens einmal im Monat einen neuen Motor brauchen wegen falscher Betankung.

Wenn du einen VW hast, ist dieser dein Eigentum und damit hast du das Recht einen Toyota-Motor einzubauen. Der Vergleich hat mit dem AppStore also gar nichts zu tun. Sondern passt eher zu Apples Reparaturverbot.
Aber gut zu wissen, dass du Apple Sonderverbote einräumst. Die du bei deinem Auto, Haus oder Schreibtischl sicher nicht akzeptieren würdest.
