EU geht weiter gegen die Steuerpraktiken von Apple und Irland vor

Die meisten werden sich vermutlich noch an die Auseinandersetzung zwischen Apple und der EU erinnern, in der es um die extrem geringen Steuern geht, die Apple an seinem Europasitz in Irland zahlt. Interessant ist dabei, dass Irland gar kein Interesse an irgendwelchen Steuernachzahlungen und dementsprechend auch an der Auseinandersetzung zwischen der EU und Apple hat. Dennoch besteht die EU darauf, dass die Steuerpraxis Apples im Zeitraum zwischen 1991 und 2007 gegen geltendes Marktrecht verstoßen habe. Entsprechend urteilte man vor vier Jahren, dass Apple für den Zeitraum zwischen 2003 und 2014 Nachzahlungen von rund 13 Milliarden Euro an Irland leisten müsse.

Sowohl Apple als auch Irland legten Einspruch gegen das Urteil ein, weswegen nun ein Gericht der Europäischen Union die Sache beurteilen musste. Das dabei ergangene Urteil kam dann doch ein wenig überraschend. Es sah nämlich nicht die EU, sondern Apple und Irland im Recht. Konkret war man der Ansicht, dass es keine unrechtmäßige Sonderbehandlung von Apple durch Irland bezogen auf irgendwelche Steuervorteile gegeben habe. Entsprechend wurde auch die Nachzahlung in Höhe von 13 Milliarden Euro, die Apple zwischenzeitlich auch auf einem Treuhandkonto geparkt hatte, annulliert.

Gestern nun, kurz vor Verstreichen der Frist hat die Europäische Kommission doch noch Einspruch gegen das Urteil eingelegt und schickt die Auseinandersetzung damit in eine weitere Runde (via CNBC). Die finale Entscheidung muss nun in letzter Instanz der Europäische Gerichtshof treffen.

Ist doch immer wieder beruhigend zu wissen, dass es gar keine Rolle spielt, wieviele Leser sich bereitwillig in die Kommentarspalten treiben lassen.
